This policy sets out essential information about Lonofi's use of your Personal Data. Together with our General Terms and Conditions of Use and our Cookies Policy, it constitutes a legally binding agreement between you and Lonofi SAS.

Before going any further, let us first agree on the following terms:

Lonofi, We, Our: Lonofi SAS.

The Platform: Any lonofi.com websites, the home.lonofi.com web application, and the Lonofi mobile applications

Services: All the services and functionalities provided by the Platform.

The User, You, Your: Anyone using the Platform.

Registered User: Any User who has registered on the Platform and has a verified account.

Identified User: Any Registered User using the Platform after having previously identified himself/herself, i. e. after having logged into his/her account.

Personal Data: Any data collected that allows you to be identified.

Ambience: All the sound environments, scenes, soundscapes or sound atmospheres available on the Platform.

Introduction

This Privacy Policy is intended to inform you of our practices regarding the collection, use, sharing and storage of information that may be provided to us when you use The Platform.

The company responsible for collecting, processing and storing this data is Lonofi SAS (839,899,663 R.C.S Paris), with a capital of €15,000.00 whose registered office is located at 57 rue Letort, 75018, Paris, France.

By accessing or using the Platform, you acknowledge that you have read and accepted this Privacy Policy, the General Terms and Conditions of Use, and the Cookies Policy. We invite you to read these documents carefully.

How do we collect data?

When using our Services, you are required to provide us with data directly in the following cases:

By registering on the Platform

When you register on The Platform, we collect Personal Data, such as your email address or username. This information is mandatory for your registration on The Platform.

Note that it is possible to access the Platform without being registered. However, most Services are only available to Identified Users.

By filling in your user profile

You may provide us with additional Personal Data by completing your user profile, such as a profile picture, your full name, your gender or your age.

Please note that only Registered Users can provide us with this data.

By using the platform

We collect data relating to your use of our Services, such as the Ambiences you listen to, create or evaluate.

By answering our surveys and questionnaires

If necessary, we may send you questionnaires or surveys relating to your use of the Platform and of our Services. The opinions and feedback collected will then be processed and analyzed.

The data we automatically collect

When using our Services, we may automatically collect certain information about you. This can come from:

A social network

In the event that you identify yourself on the Platform via a social network or access the functionalities of a social network via the Platform (e. g. Sharing, recommendation such as "I like"...), we may collect Personal Data transmitted by the social network concerned and in accordance with the General Conditions of Use of the said network.

You cannot disable the collection of this data on our Platform, but you can, however, authorize or not their distribution via the settings in the social networks in question.

In the event that you choose to register and identify yourself on the Platform via a social network (Facebook, Google), we will collect from these services the Personal Data necessary for your identification on the Platform.

The device and connection used to access the Platform

The nominative registration data are Personal Data relating to the identity of the User and used to identify him/her on the platform.

Any Registered User must provide them to us at the time of registration. Non-registered Users are not required to provide them to us.

The additional nominative data are Personal Data relating to the identity of the User.

They are optional, you provide them whenever you want, and if you want.

Only Registered Users can provide them to us.

Social network nominative data

Social networks nominative data is Personal Data that is transmitted to us by a social network (Facebook, Google, Twitter...) in accordance with its General Terms of Use.

The nature of this data depends on the social network in question and the authorizations you have set up to share your data.

They may include, for example, first name, last name, photograph, e-mail address, age, gender, number of Facebook friends...

Survey data

Survey data includes feedback and opinions collected through the sending of questionnaires and surveys to our Registered Users.

This data is optional, and obtained on a voluntary basis.

Its exact nature depends on the questionnaire. It may be an answer to the question "Would you recommend Lonofi Home to a friend?"

Technical data

Technical data is data relating to the device and the connection to access the Platform.

This data is collected for all Users, Identified or not.

For how long is this data stored?

As a general rule, we retain your Personal Data for as long as you remain a User of our Services. If this fact changes, we would then apply the following retention periods:

If you stop using our Services, your Personal Data is kept for a period of 3 years from the last time you used it.

If you decide to delete your account, your Personal Data is kept for a period of 1 year from the date of deletion of your account.

If we have deactivated, blocked or suspended your account, we keep your Personal Data for a period of 3 years from the suspension, in order to avoid any circumvention by you of the rules in force on the Platform.

After these deadlines, your Personal Data are anonymized. It is then no longer possible to identify you, and this definitively and by any means whatsoever.

We keep the anonymized data for their statistical value, as well as to guarantee the durability of our Services. Thus, the content you have created and shared on the Platform, such as evaluations or Ambiences, remain accessible to other Users once the retention period has expired, but it is not possible to identify yourself with it.

The above-mentioned retention periods may be modified in the following cases:

If there is an unresolved problem with your account, such as an unresolved claim or dispute, we will retain the necessary Personal Data until the problem is resolved;

If the data is required for our legitimate business interests, such as fraud prevention or the safety of our Users;

If we are required to retain Personal Data due to legal, tax, audit and accounting obligations, we will retain the necessary Personal Data for the period required by applicable law.

With whom do we share this data?

Sharing data with the Platform Users

As part of the use of the Platform, some of your Personal Data is shared with all Users. This may include personal data, such as a username or photograph, or usage data such as the Ambiences you created or your recommendations.

Sharing data with third parties

As a general rule, your data is not shared with third parties. However, you are informed that we may disclose your data in the following cases:

As part of a research collaboration

In the event that Lonofi participates in a research collaboration involving external partners, such as laboratories or institutes, we may share the data we have with the various research stakeholders involved in the project. If necessary, these data will be anonymized.

In the event of a merger or acquisition of Lonofi

In the event that Lonofi is required to take part in a merger transaction, or has all or part of its assets acquired by a third party, the data we hold will then be shared with or transferred to the new owner.

In the case of an acquisition by Lonofi

In the event that Lonofi acquires all or part of the assets of a third party company, we may then share the data with the seller.

In the case of a legal obligation

In the event that we are required to respond to a claim against Lonofi, to comply with a judicial request, for example in the context of an investigation or investigation, in the event of a higher emergency involving public health or the physical integrity of a person, or in order to guarantee the rights, property and safety of Lonofi, the Platform and its Users, the data in our possession may be transmitted to any competent institution and regulatory or judicial authority.

Where is this data stored, and can it be transferred?

In accordance with current regulations, you have the rights listed below concerning your data.

Right to access and right to portability

At your request, Lonofi pledges to provide you with access to your data or to provide you with a copy of all data concerning you. We do our best to ensure that this data is provided to you in an open and easily reusable format.

Right to erase

At your request, Lonofi pledges to delete part or all of your Personal Data. The latter will then either be deleted or anonymized. Please note that we may retain certain information about you when required to do so by law or when we have a legitimate reason to do so.

Right of rectification

At your request, Lonofi pledges to allow you to correct inaccurate or obsolete data concerning you.

Right of opposition

At your request, Lonofi pledges to stop the processing of your Personal Data, whether for personal reasons or to oppose the processing of your data for direct marketing purposes

Right to limitation of processing

At your request, Lonofi pledges to freeze the processing of your data by us. In this case, the latter will no longer be used, but will be kept.

Managing your data after your death

You have the right to specify instructions to us regarding the fate of your data after your death.

Modification of the Privacy Policy
